1. Who We Are

These Terms govern your use of our AI headshot generation service (“Service”). By using the Service, you agree to these Terms.

2. Eligibility

  • You must be 18+.
  • If you use the Service on behalf of an organization, you confirm you have authority to bind it.

3. Accounts

  • Keep your credentials confidential.
  • You’re responsible for all activity under your account.
  • One individual per account. No account sharing or creating multiple free accounts to bypass limits.

4. Acceptable Use

You agree not to:

  • Upload or generate content involving minors (under 18).
  • Create or share pornographic/sexual content.
  • Impersonate any person without their explicit written consent.
  • Create or share content that is defamatory, hateful, discriminatory, violent, threatening, fraudulent, or deceptive.
  • Violate privacy, IP, or other legal rights.
  • Reverse-engineer, scrape, or attempt to extract source code or data.
  • Interfere with, disrupt, or overload our infrastructure.
  • Violate any applicable law.

We may remove content or suspend accounts that violate these Terms.

5. Content & IP

  • You own the headshots and images you generate.
  • You grant us a limited, revocable license to process your uploads solely to provide the Service (and for essential operations like abuse prevention and billing).
  • No training: we do not use your uploads or outputs to train AI models.
  • You may delete your images and account data at any time (see Privacy Policy for details).

6. Payments & Subscriptions

  • Payments are processed by Stripe. Prices are shown before purchase.
  • No refunds once digital processing begins.
  • Subscriptions auto-renew unless cancelled before renewal.
  • Cancel anytime in your account or by emailing danielmoka@mokaie.com. Access continues until the end of the paid period.

7. Service Changes & Availability

  • We may add, change, or remove features, or suspend the Service.
  • We may update these Terms; material changes will be notified via the site or email.

8. Third-Party Services

The Service integrates with third parties (e.g., Stripe, Supabase, FAL.AI). Their terms and privacy practices apply to their services.

9. Disclaimers

The Service is provided “as is” and “as available.” To the extent permitted by law, we disclaim all warranties (merchantability, fitness for a particular purpose, non-infringement, and uninterrupted/ error-free operation).

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill.
  • Our aggregate liability is limited to the fees you paid in the 12 months before the claim.

Local mandatory consumer rights remain unaffected.

11. Termination

We may suspend or terminate access for violations of these Terms or legal requirements. You may stop using the Service at any time. Upon termination, your right to use the Service ends.

12. Governing Law & Venue

These Terms are governed by the laws of Hungary and applicable EU law. Courts in Hungary have exclusive jurisdiction.
